Terms of Service

These Terms of Service (the "Terms") set out the conditions for using the mobile application "WENTY" (the "App") provided by WENTY (the "Operator"). By using the App, you (a "User") agree to these Terms.

1. Application

These Terms apply to all relationships between the Operator and Users regarding use of the App. A User is deemed to have agreed to these Terms when they download the App or register an account.

2. About the App

The App is a service that lets Users record (check in to) the places they have visited together with a GPS-based "proof of visit," attach photos and short text, and share them with other Users according to the chosen visibility setting. The App is not intended to make Users compete over the number of visits or over places, nor to compel any particular behavior.

3. Account Registration

  1. Users can use the App by authenticating with an email address, by Sign in with Apple, or by authenticating with a Google account. When authenticating with Sign in with Apple or a Google account, the email address and account identifier are provided to the Operator by the respective service.
  2. Users shall manage their registration information at their own responsibility and shall not allow any third party to use it.

4. Age Requirements

To use the App, Users must meet the age requirements set by the laws of the region in which they reside. Minors may use the App only after obtaining the consent of a parent or legal guardian.

5. User Content

  1. Users may post and register content on the App such as photos, a short caption, comments, a category, visibility settings, profile information, and a profile image (collectively, "User Content").
  2. The rights to User Content belong to the User. However, the User grants the Operator, free of charge, the right to use the User Content (including storing, displaying, and copying it) to the extent necessary to provide, operate, and improve the App.
  3. Users shall post only content that they have the right to post.
  4. When a User registers another User as a "person they went with (companion)," they shall do so after obtaining that person's consent. Regarding display in a post in which they have been registered as a companion, the registered person may approve or cancel it, and the post will not be displayed as that User's post unless they approve it.

6. Visibility and Display of Records

  1. Users can set their account to be a "public account" or a "private account." For a private account, the User's posts and visited places are displayed only to followers the User has approved.
  2. For each post (check-in), Users can choose the visibility as "Public," "Followers only," or "Only me (private)." Posts set to "Public" are displayed—in the feed, on the page for that place, and elsewhere—to all Users if the account is public, or to approved followers if the account is private. Posts set to "Followers only" are displayed only to approved followers. Posts set to "Only me (private)" are not displayed to other Users. The account-level control for a "private account" (described in the previous item) applies separately from each post's visibility setting.
  3. The specifications for visibility may change as the service is improved.

7. Prohibited Acts

When using the App, Users shall not engage in the following acts.

  1. Acts that violate laws or public order and morals
  2. Acts that infringe the rights of others (such as privacy rights, likeness rights, or intellectual property rights)
  3. Defamation, harassment, bullying, or impersonation of others
  4. Posting obscene, violent, or discriminatory content
  5. Registering or posting false information
  6. Acts that interfere with the operation of the App, or acts such as unauthorized access or reverse engineering
  7. Any other acts that the Operator deems inappropriate

8. Reporting, Blocking, and Removal of Content

  1. Users can report or block inappropriate content or other Users.
  2. When a User blocks another User, the blocked User's posts and profile will no longer be displayed on the blocking User's screen.
  3. The Operator maintains a policy of not tolerating inappropriate content or harassing behavior in any way (zero tolerance).
  4. For inappropriate content that is reported, the Operator will, after review, in principle remove it or take other necessary measures within 24 hours, and may suspend or remove the account of the violating User.
  5. With respect to content or accounts that the Operator deems to be in violation of these Terms, the Operator may take measures such as suspending display, removing the content, or suspending use of the account, without prior notice.

9. Deletion of Accounts

  1. Users can delete their account at any time from the in-app settings.
  2. When an account is deleted, related data such as the profile, records, and follow relationships are deleted and, in principle, cannot be restored.
  3. Information that is subject to a legal retention obligation, or information that temporarily remains in backups, may be retained for a period determined by the Operator.

10. Paid Plan (WENTY Plus)

  1. The App offers an optional paid plan, "WENTY Plus" (an auto-renewable subscription). The basic features of the App are available without subscribing.
  2. The price, period, and any free trial are shown on the purchase screen and on the App Store. Payment is charged to your Apple ID, and the subscription renews automatically for the same period and price unless auto-renew is turned off at least 24 hours before the end of the current period.
  3. Purchases, turning off auto-renewal, cancellation, and refunds are handled through your Apple account settings and are subject to Apple's terms. The Operator does not obtain payment information such as credit card numbers.
  4. The contents of the paid plan may be changed or added to. Records and posts you created are not deleted after you cancel.
  5. Whether or not you subscribe does not change the order in which content is shown in feeds or search.

11. Changes to, Suspension of, and Termination of the Service

The Operator may change the content of the App, or suspend or terminate its provision, without prior notice to Users. The Operator is not liable for any damage incurred by Users as a result.

12. Disclaimer

  1. The Operator does not warrant that the App is fit for any particular purpose or that it is free from errors or defects.
  2. The Operator does not warrant the accuracy of the places, locations, proof status, or other information recorded in the App.
  3. Disputes between Users shall be resolved between the Users concerned, and the Operator is not liable for them.
  4. The Operator is not liable, to the extent permitted by law, for any damage arising from the use of, or the inability to use, the App.

13. Changes to These Terms

The Operator may change these Terms as necessary. The Operator will give notice of important changes within the App or by other means. If a User uses the App after a change, they are deemed to have agreed to the changed Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. In the event of a dispute regarding the App, the court having jurisdiction over the location of the Operator shall be the exclusive agreed court of first instance.

この利用規約（以下「本規約」）は、WENTY（以下「運営者」）が提供するモバイルアプリケーション「WENTY」（以下「本アプリ」）の利用条件を定めるものです。本アプリを利用する方（以下「ユーザー」）は、本規約に同意したうえで本アプリを利用するものとします。

1. 適用

本規約は、本アプリの利用に関する運営者とユーザーとの間のすべての関係に適用されます。ユーザーが本アプリをダウンロードし、またはアカウントを登録した時点で、本規約に同意したものとみなします。

2. 本アプリについて

本アプリは、ユーザーが訪れた場所を、GPSによる「行った証明」とともに記録（チェックイン）し、写真や短い文章を添えて、設定した公開範囲に応じて他のユーザーと共有するためのサービスです。本アプリは、訪問数や場所を競わせたり、特定の行動を強制したりすることを目的としていません。

3. アカウント登録

  1. ユーザーは、メールアドレスによる認証、Sign in with Apple、またはGoogleアカウントによる認証により、本アプリを利用できます。Sign in with Apple または Google アカウントで認証する場合、各サービスからメールアドレスおよびアカウント識別子が運営者に提供されます。
  2. ユーザーは、登録情報を自己の責任において管理するものとし、第三者に利用させてはなりません。

4. 年齢に関する要件

本アプリの利用にあたっては、ユーザーが居住する地域の法令で定められた年齢要件を満たす必要があります。未成年者が利用する場合は、親権者などの同意を得たうえで利用するものとします。

5. ユーザーコンテンツ

  1. ユーザーは、本アプリ上で写真、ひとこと、コメント、カテゴリ、公開範囲、プロフィール情報、プロフィール画像などのコンテンツ（以下「ユーザーコンテンツ」）を投稿・登録できます。
  2. ユーザーコンテンツの権利はユーザーに帰属します。ただし、ユーザーは運営者に対し、本アプリの提供・運営・改善に必要な範囲で、ユーザーコンテンツを利用（保存、表示、複製など）することを無償で許諾するものとします。
  3. ユーザーは、自らが投稿する権利を有するコンテンツのみを投稿するものとします。
  4. ユーザーは、他のユーザーを「一緒に行った人（同行者）」として登録する場合、相手の同意を得たうえで行うものとします。同行者として登録された投稿への表示について、登録された側は承認または取消しを行うことができ、承認しない限り当該ユーザーの投稿として表示されることはありません。

6. 公開範囲と記録の表示

  1. ユーザーは、アカウントを「公開アカウント」または「非公開アカウント」に設定できます。非公開アカウントの場合、ユーザーの投稿および行った場所は、ユーザーが承認したフォロワーにのみ表示されます。
  2. ユーザーは、投稿（チェックイン）ごとに、公開範囲を「公開」「フォロワーのみ」「自分のみ（非公開）」から選択できます。「公開」に設定した投稿は、公開アカウントの場合はすべてのユーザーに、非公開アカウントの場合は承認したフォロワーに、フィードやその場所のページなどで表示されます。「フォロワーのみ」に設定した投稿は、承認したフォロワーにのみ表示されます。「自分のみ（非公開）」に設定した投稿は、他のユーザーには表示されません。なお、アカウント自体を「非公開アカウント」に設定した場合の表示制御（前項）は、各投稿の公開範囲とは別に適用されます。
  3. 公開範囲の仕様は、サービスの改善に伴い変更されることがあります。

7. 禁止事項

ユーザーは、本アプリの利用にあたり、次の行為をしてはなりません。

  1. 法令または公序良俗に違反する行為
  2. 他者の権利（プライバシー権、肖像権、知的財産権など）を侵害する行為
  3. 他者への誹謗中傷、嫌がらせ、いじめ、なりすまし
  4. わいせつ、暴力的、差別的なコンテンツの投稿
  5. 虚偽の情報を登録・投稿する行為
  6. 本アプリの運営を妨害する行為、または不正アクセス・リバースエンジニアリングなどの行為
  7. その他、運営者が不適切と判断する行為

8. 通報・ブロック・コンテンツの削除

  1. ユーザーは、不適切なコンテンツや他のユーザーを通報・ブロックできます。
  2. ユーザーが他のユーザーをブロックした場合、ブロックされたユーザーの投稿・プロフィールは、ブロックしたユーザーの画面に表示されなくなります。
  3. 運営者は、不適切なコンテンツおよび嫌がらせ行為に対して、これを一切許容しない方針（ゼロトレランス）をとります。
  4. 運営者は、通報を受けた不適切なコンテンツについて、確認のうえ原則として24時間以内に削除その他の必要な措置を行い、違反したユーザーのアカウントを停止または排除することがあります。
  5. 運営者は、本規約に違反すると判断したコンテンツやアカウントについて、事前の通知なく、表示の停止、削除、アカウントの利用停止などの措置を講じることができます。

9. アカウントの削除

  1. ユーザーは、アプリ内の設定からいつでもアカウントを削除できます。
  2. アカウントを削除すると、プロフィール、記録、フォロー関係などの関連データは削除され、原則として復元できません。
  3. 法令上の保存義務がある情報や、バックアップ上に一時的に残る情報については、運営者の定める期間保持されることがあります。

10. 有料プラン（WENTY Plus）

  1. 本アプリには、任意の有料プラン「WENTY Plus」（自動更新のサブスクリプション）があります。有料プランに加入しなくても、本アプリの基本的な機能は利用できます。
  2. 料金、期間、無料お試しの有無は、購入画面および App Store に表示されます。支払いは Apple ID に請求され、現在の期間が終わる24時間前までに自動更新をオフにしない限り、同じ期間・料金で自動的に更新されます。
  3. 購入、自動更新の停止、解約、返金は、Apple のアカウント設定と Apple の定めに従います。運営者は支払い情報（クレジットカード番号など）を取得しません。
  4. 有料プランの内容は、変更または追加されることがあります。解約した後も、それまでに作成した記録や投稿は削除されません。
  5. 有料プランへの加入の有無によって、フィードや検索での表示順を変えることはありません。

11. サービスの変更・中断・終了

運営者は、ユーザーへの事前の通知なく、本アプリの内容の変更、提供の中断または終了を行うことができます。これによりユーザーに生じた損害について、運営者は責任を負いません。

12. 免責事項

  1. 運営者は、本アプリが特定の目的に適合すること、エラーや不具合がないことを保証しません。
  2. 本アプリで記録される場所、位置、証明の状態その他の情報の正確性について、運営者は保証しません。
  3. ユーザー間のトラブルについては、当該ユーザー間で解決するものとし、運営者は責任を負いません。
  4. 運営者は、本アプリの利用または利用不能から生じるいかなる損害についても、法令で認められる範囲で責任を負いません。

13. 本規約の変更

運営者は、必要に応じて本規約を変更することができます。重要な変更については、本アプリ内またはその他の方法で通知します。変更後に本アプリを利用した場合、変更後の規約に同意したものとみなします。

14. 準拠法・管轄

本規約は日本法に準拠します。本アプリに関して紛争が生じた場合、運営者の所在地を管轄する裁判所を第一審の専属的合意管轄裁判所とします。
